President Bola Tinubu has declined to sign the National Drug Law Enforcement Agency (NDLEA) Bill, 2025 into law.
The decision was communicated in a letter read in the House of Representatives on Thursday during plenary. In the letter, Tinubu cited Section 58(4) of the 1999 Constitution (as amended) as the basis for his decision.
According to the President, the bill seeks to grant the NDLEA the power to retain a portion of proceeds recovered from drug-related crimes, a provision he said conflicts with Nigeria’s existing financial regulations.
Tinubu explained that under the current legal framework, all proceeds from crime are to be paid into the government’s Confiscated and Forfeited Properties Account. Disbursement from this account to any recovery agency, including the NDLEA, requires presidential approval and must also be subject to the consent of both the Federal Executive Council and the National Assembly.
The President stated that there was no compelling justification to modify the current system, which is designed to maintain transparency and accountability through executive and legislative oversight.
